Terms & Conditions

Necessary Equipment /Service provided by Client:

1. Welding machine (3 phase 200/300 amp with welding cable, welding rod and accessories.
2. Gas cutter with 10 meter pipe 2 Nos .one for LPG and one for Oxygen.
3. Cable electric wire.
4. Grinder machine 4’’ & 7’’.
5. 2 Hydro cranes of 15 Ton.
6. Accommodation and food facility for Engineers & Labours

Clients Contractual Obligation:

1. You agree that the foundation along with preparatory work shall be ready and the proper current available by the required date ,after which we are to have their uninterrupted use.
2. Necessary Electrical power supply to arrange in the plant premises before erection starts

Warrantee.

All product /materials either manufactured or assembled by us are warrantee for a period of ONE year commencing from the date of handling of plant , Supply of material whichever is earlier , against any defective workmanship or defective material . During this period we will repair/replace the defects/unserviceable parts which will occur due to manufacturing defects or improper workmanship but not due to use or care.

In our warrantee, we do not cover Main Switch, Blowers, Gears, Pinion, Rollers, Trunion Rollers , Tyre Ring etc.. We accept no liability for defect, depreciation caused by damage in transit, wear & tear, accidents, Lightening, rain dampness, misuse or other abnormal condition beyond ours.

Force Majeure:

We shall not liable for direct ,indirect or consequential loss , damage , delay due to any cause beyond our control including embargos , Statutory rules & regulations – orders & requisites issued by any government , Strikes , Lockdowns , accidents , explosion , riots , power shortage , delay in supplies of any / or non – availability of essential raw materials, and component , energy crisis , power cut , rail /road transporters strikes. Act of god of the states or act of a third party other natural calamities either at our suppliers work or at our works or at installation site due to any or all of the reasons. If any of the above Force Majeure takes place at clients city /state or at installation site before /after delivery of materials, then client/contractor/purchaser must immediately inform to Shiva Techno Fab by mail/tax with the likes of duration of persistence of force major.

Title of Property:

Any material supplied by us shall remain our property until full payment is received. We also reserve the right to remove equipment supplied by us to discontinue work at your cost in case of default of payment by you irrespective of the manner of attachment of Reality, Sale, Mortgage or Lease of premises.

Cancellation /Termination of Contract.

In the event of cancellation of contract due to any reason whatsoever, the following schedule of compensation to us will be borne by client.

1. 10% of the contract value if the order is cancelled before preparation of G.A. Drawing.
2. 25% of the contract value, if the order is cancelled after 30 days of Signing of contract.
3. 45% of contract value, if the order is cancelled after 30 days but before 60 days of signing of contract.
4. 85% of contract value, if the order is cancelled after 60 days or after the intimation of materials readiness at Shiva Techno Fab works for dispatch.

In the event of failure /neglect of clients, to take delivery of materials and/or to offer the site for erection or forfeited. The plant within the agreed time, we may treat this contract terminated and payment made if any.

Jurisdiction of Courts:

The Court of Ahmedabad, Gujarat shall have the Jurisdiction to set a dispute arising out of Contract
